Digital Products Terms & Image Licence

These terms apply to digital images, artwork, designs and photography purchased from MVB Studio. By purchasing or downloading a digital product from us, you agree to these terms and the licence below.

1. About our digital products

Our digital products may include original graphic designs created by us, photographs taken by us, AI-generated or AI-assisted artwork, and works that combine human-created and AI-generated elements.

Unless a product listing states otherwise, digital products are supplied as downloadable image files such as PNG, JPG or similar formats.

2. Licence granted

When you purchase a digital image from us, you receive a non-exclusive, non-transferable licence to use that image in accordance with these terms. You are not purchasing ownership of the underlying intellectual property or any exclusive rights.

You may:

• Use the image for personal projects.
• Use the image in commercial projects.
• Use the image on websites, social media, advertisements, presentations and other marketing materials.
• Use the image in printed materials such as invitations, stationery, leaflets, posters and packaging.
• Use the image as part of a physical end product for sale, including products such as mugs, clothing, phone cases, cards, prints and similar items.
• Edit, crop, resize, recolour, add text to, or otherwise adapt the image for your permitted use.

You may not:

• Resell, redistribute, share, sublicense or give away the original digital file, whether modified or unmodified.
• Upload the original file to stock-image websites, design libraries, marketplaces, file-sharing platforms, print-on-demand libraries, asset libraries or similar services where other users can download or extract it.
• Sell the image as a standalone digital download, clipart file, digital paper, template asset or other digital file that is substantially the same as the purchased image.
• Claim that you created or photographed an image where you did not do so.
• Use the image in a way that is unlawful, defamatory, deceptive, hateful or infringes another person's rights.
• Register the unmodified image as a trademark, logo or other exclusive brand identifier.

3. Physical products for resale

You may use a purchased image on physical end products that you sell, provided the digital image itself cannot be extracted or downloaded by your customer as a reusable asset.

This standard licence does not give you exclusivity. The same or similar image may be licensed to other customers.

4. AI-generated and AI-assisted content

Some products may be created wholly or partly using artificial intelligence tools. Where applicable, we grant you the rights that we hold and are entitled to grant in the relevant digital product.

We do not guarantee that AI-generated content is unique, that similar outputs have not been generated for others, or that every AI-generated element qualifies for copyright protection in every jurisdiction.

You are responsible for ensuring that your use of any purchased image is appropriate for your intended purpose and complies with applicable law.

5. Our own designs and photography

Where a product consists of our original graphic design, illustration, layout or photography, all rights not expressly granted to you under this licence are reserved by MVB Studio or the applicable rights holder.

You must not reproduce, distribute or exploit those works outside the permissions granted by this licence.

6. Third-party rights

You must not use our digital products in a way that infringes third-party copyright, trade marks, privacy, publicity or other legal rights.

If a design includes third-party material under a separate licence, the product listing may include additional restrictions. Those restrictions will form part of your licence.

7. Digital delivery

Digital products are supplied electronically. No physical item will be posted unless the product listing specifically states otherwise.

You are responsible for providing a valid email address and for ensuring that your device and software can open the file type supplied.

8. UK cancellation rights and digital content

If you are a UK consumer, you may normally have a 14-day right to cancel certain online purchases. However, for digital content that is not supplied on a tangible medium, your right to cancel may be lost once download or access begins if you have expressly consented to immediate supply and acknowledged that this means losing your cancellation right.

Where required, we may ask you to provide that consent before giving immediate access to a digital download.

This does not affect your statutory rights if digital content is faulty, not as described or otherwise does not meet applicable legal requirements.

9. Refunds

Because digital products can be accessed or downloaded immediately, we do not normally offer refunds for a change of mind once access or download has begun, except where required by law.

If you receive a corrupted, incomplete or incorrect file, please contact us and we will take reasonable steps to provide a replacement or correct the issue.

10. File quality and colour

We aim to describe file dimensions, resolution and format accurately in each product listing. Colours may vary between screens, printers, inks, papers, fabrics and other production methods. We cannot guarantee an exact colour match between a digital preview and a finished printed product.

11. No exclusivity

Unless a separate written exclusive licence is agreed with us, every licence is non-exclusive. Other customers may purchase and use the same design or a similar design.

12. Prohibited automated use

You may not use purchased files to build, train, fine-tune or populate an image-generation model, dataset, asset library or similar system for redistribution without our prior written permission.

13. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or any rights that cannot be excluded under consumer law.

Subject to applicable law, we are not responsible for indirect or consequential loss arising from your use of a digital product, or for losses caused by using the product in a way that is outside this licence.

14. Termination of licence

If you materially breach this licence, your permission to use the digital product may end. On termination, you must stop any new prohibited use and stop distributing the digital file itself.

15. Changes to these terms

We may update these terms from time to time. The licence that applies to a purchase is the version in force when that purchase was made, unless a change is required by law.

16. Governing law

These terms are governed by the laws applicable in the United Kingdom, subject to any mandatory consumer rights that apply to you based on where you live.
